M. Ellis called the meeting to order at 8:36 PM.  

New Business

File PZC2007-17- Application for Resubdivision of Lot 7 Mihaliak Road Ext. & rosemary Lane (Map 50, Lot 3, and Zone R80).  Lechowiz Farms Estates Owner/Applicant: Mary C Litwinczyk & Litwinczyk Children, LLC (Received 6-19-07, P. H. 8-21-07. Dec within 65 days after close of P. H.)

Public Hearing will be held on 8/17/07

File PZC2007-20 Application for Modification of special permit and Final Site Development plan at 15 River Road (Map 5, Lot 3, Zone DC) Owner/Applicant: Amy G Moore (Received July 17, 2007, P. H. by Sept. 18, 2007, Decision within 65 days after close of P.H.

Ms. Moore and her attorney were present.  The attorney asked if the public hearing will be held.  The commission members said they would set a date.  He stated that the applicant had prepared booklets as to her plans for the commission members.  The booklets were submitted into the record.  
R. Tulis made a motion to set a public hearing for File PZC2007-20  Application for Modification of special permit and Final Site Development plan at 15 River Road (Map 5, Lot 3, Zone DC)  Owner/Applicant: Amy G Moore on 8/21/07.  P. Nevers seconded the motion.  All members were in favor.  

M. Ellis asked if the use of the patio is in the plan modification.  Ms. Moore said it was.  M. Ellis asked if the patio is currently being used.  Ms. Moore said it is used for smoking only.  Attorney Burn stated that Ms. Moore received a letter from the town stating that there were to be no tables, chairs, or benches on the sidewalks.  He stated that Ms. Moore did not think that included the patio so she continued to use it.  
R. Tulis asked if the liquor commission allows drinking on patios.  Ms. Moore said that alcohol is not permitted on the patio only smoking.  

M. Ellis asked Ms. Moore to ask the commission for exactly what she needs her special permit for as that is what they can or can not approve, a special permit can not be added upon.  M. Ellis stated that all the issues involving the application should be dealt with together at the next meeting.  

Review and approval of renewal of special permit for American Eagle Saloon & Café.  15 River Road (Map 5, Lot 3) Owner/Applicant: Amy Moore

Public hearing set for 8-21-07

File PZC2007-21- Application to Amend the Zoning Regulations 451 River Road (Map 34, Lot 6) Owner/Applicant TJF, LLC (Received July 17, 2007 public hearing by Sept. 17, 2007, Decision within 65 days after close of public hearing).

R. Tulis made a motion to set public hearing for 8/21/07.  N. Gray seconded the motion.  All members voted in favor.

File PZC2007-23- Application for Sign Permit 60 Old Farms Road (Map 71, Lot 1) Owner/Applicant: Town of Willington (Received July 17, 2007 public hearing by Sept. 18, 2007 Decision within 65 days after close of public hearing)

The commission members looked at the proposed sign for the new senior housing.  S. Yorgensen discussed what additional information would be needed for approval.  J. Poole stated that he feels that the application is incomplete and the town should be held to the same standards that the public is.  A. Marco agreed that there is not enough information in the application for the commission to make a decision.  R. Tulis suggested giving the town until the next meeting to complete the application and if they do not receive it by then, the application will be denied.  

Old Business

File 2007-07- Application for a 6 lot Subdivision located at 150 Clint Eldredge Road.  (Map 12, Lot 20, 21.07 acres, R80 Zone).  Owner/ Applicant CE Road LLC.  (Received 2/20/07, Public Hearing 4/03/07, continued to 5/1/07, continued to 6/5/07, extension granted, continued to 6/19/07.  (Decision by 8/21/07)

The commission members looked through the minutes from all of the public hearings regarding this application, as well as the information presented in the application itself.  S. Yorgensen stated that she is still waiting for a memo from Mr. Acimovic.  
M. Ellis stated that all the original drainage issues seem to have been addressed; as well the applicant obtained an easement from the Goodrich property and met all the Conservation Commissions requests.  He stated that the commission can make conditions to an approval regarding Mr. Acimovic concerns.  
J. Poole asked if the vernal pool is included in the wetland conservation.  M.  Ellis said that it is.  

T. Murphy stated that he would like to see the common driveway legal information worded into the deed.  
J. Poole said that he would like hours of operation for construction worded into the motion as well.  

Minutes
M. Ellis made a motion to approve the 6/19/07 minutes.  N. Gray seconded.  R. Tulis abstained, all other members voted in favor.
R. Tulis made a motion to approve the 6/5/07 minutes.  N. Gray seconded.  M. Ellis and P. Latincsics abstained, all other members voted in favor.  

Correspondence
1.      Letter from Christine Beebe regarding the request to have a town resident only craft fair on the town green.
2.      Letter from DOT regarding Willington Rest area


Staff Report

The commission members set a meeting for 8/7/07 at 6:30 pm to start drafting new regulations.  

R. Tulis made a motion to adjourn at 9:11 PM.  A. Marco seconded the motion.
